Second Suspect Surrenders in Fatal Home Invasion

Riverhead - (WALK) A second suspect in a home invasion and the murder of an Eastport man last month surrendered to authorities at state Supreme Court and pleaded not guilty Thursday.

Matthew Rooney, 22, of Memorial Boulevard, East Moriches, is accused with fellow-defendant Paul Batterson Jr., 22, also of East Moriches, of storming into a house on East Moriches Boulevard and fatally shooting Francisco Pirir Canel, 45, and wounding his uncle, Cipriano Pirir Patzan shortly before 3:30 a.m. on December 8.

Prosecutors say Batterson (photo) and Rooney shot and kicked their way into the house and demanded money from the residents, believed to number as many as seven men who are employed as landscapers.

When Pirir Canel said he had no money and threatened to call police, Batterson shot him.  The suspects then fled the scene; prosecutors did not say if the invaders stole anything from the house.

The murder weapon, a shotgun, was recovered from Batterson's home.  He was arrested on January 18.

Rooney and Batterson both pleaded not guilty to charges of second degree murder and first degree assault.
